In her father's will of 1734 she is referred to as Frances Avent. She gave evidence before witnesses "at the house of Thomas Whiting at the sign of the Bell, Modbury" on 17th January 1739 in a deposition for the Chancery Court (PRO reference C 11/2785/16). This document says she is aged 52 and is the wife of Robert Avent of Dartmouth. In a later pleading before the Chancery Court of 1770 (PRO reference C 12/1322/46) it is stated that Frances died on 24th Jun 1758.
Our note: There is clearly a conflict between the Chancery Court date of death, and the Parish Register date of burial. The Parish Register is very legible at this date, but was clearly written quite some time after the actual event

James' will was made on 20th Jan 1742 and was proved on 21st July 1743 (PRO reference PROB 11/728). In a Chancery Court case of 1770 (PRO reference C 12/1322/46) it is stated that James died in January 1742.
Our note: The Modbury Parish Registers after 27 March 1741 follow the modern convention of the year starting on 1st January. They were clearly re-written in about 1775 by which time the modern convention was in use. Under the old convention, James died in January 1742/3. Certainly James' burial was recorded in the registers after burials for December 1742.

Although married to John Hingston, by 1734 Anne had separated from him. Her father Henry Legassicke {I10920} makes provision in his will of 1734 for the support of Anne and her two daughters, allowing for £30 a year received in maintenance from his "very unkind" son-in-law John Hingston.

According to Foster's "Alumni Oxoniensis", Henry went to Wadham College, Oxford, matriculating aged 17 on 13th July 1706. There is no record, however, of Henry completing his degree. In a deposition for the Chancery Court (PRO reference C 11/2785/16) of 17th Jan 1739 he is referred to as "an unfortunate lunatick". In his will of 1734 his father (Henry Legassicke {I10920}) establishes a trust for Henry's care, under the control of his older sister Elizabeth. Some years later, in a pleading at the Chancery Court of 1770 (PRO reference C 12/1322/46), it is stated that Henry the younger died on 6th Dec 1756.

Note: The connection of 'Mary Prestwood' as being the wife of James Legassicke was found in Dwight Anderson's family tree at RootsWeb. Henry was Vicar of Modbury. According to Foster's "Alumni Oxoniensis", he matriculated at Pembroke College Oxford aged 17 on 22nd Oct 1734. He does not appear to have taken a degree and he is then recorded in Venn's "Alumni Cantabrigiensis" as matriculating at St John's College Cambridge aged 20 on 8th July 1737. He was awarded a degree in 1740. Venn's book also states that Henry was at school at Winchester and that he had been admitted to the Middle Temple on 8th Aug 1735.
In an oration before the Chancery Court concerning Legassicke inheritances in 1770 (PRO reference C 12/1322/46) it is stated that Henry died on 29th March 1763. In this court case Henry is described as having been indolent and ignorant and "wholly unacquainted with Business, distressed in his circumstances, easily imposed upon and ignorant of his Grandfather's Will".
